NBA star's ex-wife arrested in child custody, visitation dispute

Many Texas parents who have ever been involved in a custody dispute, or know someone who has know things do not always go smoothly when it comes to visitation schedules and court-ordered parenting time. Such is the case between NBA player Dwyane Wade and his ex-wife in an incident that occurred over Father's Day weekend.

As a result of a delay in the return of his children for Father's Day, and the arrest of his ex-wife, Siovaughn Funches-Wade, Mr. Wade has asked a family court judge to suspend his ex-wife's visitation rights. A hearing is scheduled for this week in the matter. After posting a $10,000 bond Funches-Wade was released pending her next court appearance in August.

Mr. Wade's ex-wife was arrested on two counts of attempted child abduction, two counts of unlawful interference of visitation and one count of resisting arrest, according to reports. All the charges are considered misdemeanors.

Court papers filed by Mr. Wade state he is accusing his ex-wife of using their two children as "proverbial pawns" in the couple's rather contentious divorce action. He is asking the court to take action to protect his children from further harm by the tactics used by his ex-wife during her parenting time with the children. The two boys were scheduled to be picked up by Mr. Wade's sister on Saturday afternoon to spend Father's Day weekend with their dad.

After receiving no response at the home of Funches-Wade and waiting for several hours, the Sheriff's office was called in to assist in the matter. Apparently Ms. Funches-Wade attempted to leave the premises without the children, although they were inside with another woman who was also charged with resisting arrest in the incident.

The couple divorced in 2010 and Mr. Wade was awarded custody in March of last year. That custody ruling was appealed by Ms. Funches-Wade in December, however her appeal was denied. The couple has yet to work out a financial agreement in their divorce, and discussions are scheduled to resume on that matter in September. Mr. Wade has written a book scheduled to be released later this year dealing mainly with fatherhood and his custody fight for his kids.
