Child Support and Modification

Calculating and Enforcing Texas Child Support Obligations

In Texas, child support payments are calculated through the application of the Texas Child Support Guidelines. These determine the paying parent's net resources (not the same as net income) and apply a formula for monthly payments based on the number of children to be supported. If you feel that the Guidelines either underestimate or overestimate the payment that you'll be making or receiving, the court can consider a number of factors and order an adjustment.

Texas family law attorney Wendy Wood advises and represents parents on either side of a child support dispute, motion to modify child support obligations due to changed circumstances, or motion to enforce unpaid child support. Our team takes the time to get to know you and the details of your situation. Not only does this help us find the right solution to your problem, our close relationships with our clients improve the likelihood that we can convincingly explain the full story of your situation to a court.

At the Law Offices of Wendy Wood, we can show you how a careful consideration of the factors that might raise or lower a child support obligation can affect your rights.

Tuition payments, child care expenses, a company car, alimony or spousal maintenance payments, or a child's special needs are just a few examples of the considerations that can be brought to a court's attention to vary the Child Support Guidelines.

Major changes in the circumstances of either the person making the payments, the person receiving them, or the child's needs after divorce or paternity determination can also support a motion for modification of child support obligations. Wendy can take a close look at your situation, and use her knowledge of the Texas Family Code to help you get the most out of your day in court. If a judge won't likely change your child support arrangements, she'll tell you that, too.

Until recently, Texas child support obligations were only figured from the first $6,000 of net resources. Now the limit is $7,500. In other words, you might be entitled to an upward modification of child support payments if your ex earns a high income. Let an experienced family law attorney advise you.
